The report aims to answer two key questions: (1) What do women contest in courts regarding property rights and what challenges do they face during court proceedings? and (2) What are the main challenges of the judicial system in handling these cases? To answer these questions, the report begins with a chapter on the methodology used and the legal framework. The following chapter addresses the systemic and procedural challenges of the courts, including lack of capacity, delays in proceedings and legal representation. In two separate chapters, the report focuses on the two most frequent dimensions of disputes, division of property after divorce and inheritance, to show how gender inequalities are concretely manifested in these processes. The report concludes with recommendations aimed at strengthening judicial efficiency and transparency, as well as advancing gender equality when it comes to the exercise of property rights.
