On March 21, Group for Legal and Political Studies organized a Roundtable Discussion on the topic: “The Constitutional Court of Kosovo and Compensation: Different interpretation”, held in Prishtina. The aim of this event was to discuss the approach of the Constitutional Court regarding the authorizations concerning compensation for damages related to the jurisdiction arising from Article 113.7 of the Constitution of Kosovo.
At the beginning of the event, GLPS presented a Policy Analysis titled: “Lost, ‘in the Twilight Zone’ Rebutting the Court’s Blunder”, which analyses the issue of compensatory remedies per Kosovo’s Constitutional Court jurisdiction. Accordingly, GLPS presented its conclusion that the Constitutional Court does have the authority to decide on compensation, when the latter seized with such claims within the framework of Article 113.7 of Kosovo’s Constitution. The participants who seized the opportunity to present their views underscored the importance that compensatory relief has for the protection of human rights. Further they addressed issues of the peculiar context that Kosovo has in relation the European Court of Human Rights’ jurisprudence, and issues that continue to take part in our legal system, such as lengthy proceedings and the expertise of judges – as all of these interject with the aspect of just satisfaction and protection of human rights
