A Paper on Judicial-Constitutional Review Released …

There has been a paper on the Models of Judicial-Constitutional Review just released by the Research Committee of the Group for Legal and Political Studies. The paper discusses the phenomenon of judicial-constitutional review and the institutional models that perform that function. As a result, the paper seeks to build a hypothesis that explains the rationality of the two ‘most representative models’: the American and European one. In the end, the paper builds a hypothesis that shows the rationale of each of these models, arguing the linkage between the model of judicial-constitutional review chosen and the whole governing system’s structural rationality. Consequently, the paper argues that, the American model of judicial-constitutional review shows a higher potentiality for respecting and recognizing the legitimacy of the legislature’s acts.
